These Terms of Use (“Terms”) govern your access to and use of the Peak Skin AI mobile application, website, and related services (collectively, the “Service”), provided by Peak Skin Ltd (“Peak Skin AI”, “we”, “us”, or “our”).

By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About Us

Peak Skin AI is a skincare and dermatology support app that provides AI-powered skin analysis, skincare insights, and educational content. It is not a medical device and does not replace professional medical advice, diagnosis, or treatment.

2. Eligibility and Account Registration

2.1 Age Requirements

The Service is intended for users aged 16 and over. By using the Service, you confirm that you are at least 16 years old, and if you are under 18, you have permission from a parent or legal guardian. We may terminate or suspend accounts used in breach of this clause.

2.2 Account Creation

To use certain features, you may need to create an account. You agree to provide accurate and current information, keep your login credentials confidential, and notify us immediately at support@peakskin.ai of any unauthorised use of your account. You are responsible for all activities that occur under your account.

3. Nature of the Service — No Medical Advice

3.1 Knowledge Companion — Not a Medical Service

Peak Skin AI is a clinical knowledge companion that provides informational and educational content only. It uses AI to surface evidence from curated references, textbooks, and published guidelines to support clinical learning and professional development. The Service is not a medical device, does not provide medical advice, diagnosis, or treatment, and is not a substitute for consultation with a qualified doctor or dermatologist. AI-generated outputs must be independently verified by a qualified healthcare professional before any clinical application.

3.2 Medical Disclaimer

Always seek the advice of a qualified healthcare professional with any questions regarding a medical condition or treatment. Never disregard professional medical advice or delay seeking it because of something you have read or seen in the Service.

If you have a medical emergency or serious concern (e.g. possible skin cancer, rapidly changing lesion, severe rash, pain, or systemic symptoms), contact a healthcare professional or emergency services immediately. We do not guarantee the accuracy, completeness, or suitability of any AI outputs or content for your specific circumstances.

4. Use of the Service

You agree to use the Service in accordance with these Terms and applicable law. You must not:

  • Upload images or content that are unlawful, harmful, abusive, defamatory, obscene, or infringe any third-party rights
  • Upload images of other individuals without their explicit consent
  • Attempt to reverse-engineer, decompile, or modify the Service or underlying software
  • Use the Service to train competing AI models, or for reselling, scraping, or harvesting data
  • Use the Service for any commercial or research purposes without our prior written consent

We may suspend or terminate your access if we reasonably believe you have breached these Terms.

5. Image Uploads and AI Analysis

5.1 Image Content

When you upload images for analysis, you confirm that you own the images or have permission to upload them, the images are of yourself or you have explicit consent from any other identifiable person, and the images do not contain nudity that violates app store or legal restrictions.

5.2 How AI Analysis Works

Your images may be securely transmitted to our servers and/or our third-party AI providers to generate skin analysis results. AI results are estimates based on patterns and are not clinically validated diagnoses. We may anonymise and aggregate data to improve our models and service, in line with our Privacy Policy.

6. Data Retention

6.1 Retention Period

We retain your personal data, including AI conversation history, query logs, cached responses, and uploaded content, for a maximum of one (1) year from the date of creation or last activity, unless a longer retention period is required by applicable law or regulation.

6.2 Automatic Deletion

After the one-year retention period, your AI conversation history, query logs, and associated metadata will be automatically purged from our systems. Anonymised and aggregated data that cannot be used to identify you may be retained indefinitely for service improvement purposes.

6.3 Earlier Deletion

You may request deletion of your data at any time by contacting support@peakskin.ai or using the account deletion feature within the app. We will process deletion requests within 30 days, subject to any legal obligations requiring us to retain certain records.

6.4 Private Mode Data

When using Private (offline) mode, your queries are processed entirely on your device. No conversation data is transmitted to our servers or any third party. Data stored locally on your device is subject to your own device management and is not covered by our server-side retention policy.

7. Subscriptions, Fees and Billing

7.1 In-App Purchases and Subscriptions

Some features of Peak Skin AI are available only via paid subscription or one-off in-app purchases. Prices and available plans are displayed in the app and may vary by region and platform. Purchases are processed through the relevant app store (Apple App Store, Google Play, etc.).

7.2 Auto-Renewal

If you purchase a subscription, it may automatically renew at the end of each billing period unless you cancel at least 24 hours before renewal. You can manage or cancel your subscription via your app store account settings.

7.3 Free Trials

We may offer free trials of paid features. If you do not cancel before the trial ends, you may be automatically charged for the next billing period.

7.4 Refunds

Refunds are typically handled by the app store under their policies. Contact the App Store / Google Play directly to request a refund, where applicable.

8. Intellectual Property

8.1 Our Rights

All rights in and to the Service, including software, code, algorithms, design, branding, logos, text, graphics, and other content are owned by or licensed to Peak Skin Ltd and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use in accordance with these Terms.

8.2 Your Content

“Your Content” means images, text, or other materials you upload or submit to the Service. You retain ownership of Your Content. However, by uploading or submitting content, you grant us a worldwide, non-exclusive, royalty-free licence to use, host, process, store and display Your Content, generate AI outputs based on Your Content, and create anonymised and aggregated data for improving our models and services.

We will not use your identifiable photos for external marketing or public display without your explicit consent.

9. Third-Party Services

The Service may integrate with or link to third-party services, such as cloud hosting and AI model providers, analytics and crash reporting tools, and app store payment platforms. We are not responsible for third-party terms, policies, or actions.

10. Availability and Modifications

We aim to keep the Service available and up to date but do not guarantee uninterrupted access, that the Service will be error-free, secure, or free from bugs, or that any particular feature will continue to be available. We may modify, update, or remove parts of the Service, introduce new features, or suspend or discontinue parts or all of the Service.

11. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited under applicable law.

Subject to the above, to the fullest extent permitted by law the Service is provided on an “as is” and “as available” basis, without warranties of any kind. We do not guarantee that any AI analysis or recommendations are accurate, complete, or suitable as a basis for medical decisions.

Our total aggregate liability to you for any claims arising out of or in connection with the Service or these Terms shall be limited to the total amount you have paid to us for the Service in the 12 months preceding the event giving rise to the claim.

12. Indemnity

You agree to indemnify and hold harmless Peak Skin Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Service, your breach of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms, we are required to do so by law, or we discontinue the Service. You may stop using the Service at any time and delete your account by contacting support@peakskin.ai or using in-app account deletion where available.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date. For material changes, we may notify you via the app or email. Your continued use of the Service after changes are posted will constitute acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of England and Wales. You and we agree that the courts of England and Wales shall have exclusive jurisdiction, except where mandatory consumer protection laws in your country of residence provide otherwise.
